When a school moves to suspend a student beyond five days, New York requires a formal hearing. Families are often unaware of what that process guarantees them.
You have the right to notice and to be heard
Written notice must describe the charges with enough detail to prepare. You may be represented, present evidence, and question witnesses.
Ask for the record
Request the disciplinary file, witness statements, and any video before the hearing. What is in the file is frequently narrower than the charge suggests.
Special education changes the analysis
If the student has an IEP or 504 plan, a manifestation determination review may be required before discipline proceeds.
Preparation, not volume, decides these hearings. If your family is facing one, reach out early.
